Terms and Conditions

1. General Information

  1. This document defines the rules for using the website, the method of processing personal data, and the rules for sending the newsletter.

2. Website Usage and Order Rules

  1. The website presents products offered by Zmyślni.
  2. Purchase is possible by sending an e-mail to the address indicated on the website.
  3. The entire sales process is carried out via e-mail — including determining details, payments, and delivery.
  4. Product prices (if provided) are commercial information and do not constitute an offer within the meaning of the Civil Code.
  5. The Administrator reserves the right to typographical errors and technical errors in product descriptions, prices, or information on the website. Such mistakes do not constitute a commercial offer within the meaning of the Civil Code.
  6. The information about products contained on the website is for informational purposes and may change. The Administrator reserves the right to change the offer without prior notice.

3. Newsletter

  1. The user can subscribe to the newsletter by providing their e-mail address.
  2. The newsletter may contain information about new products, company events, and individually tailored offers.
  3. The newsletter is sent based on consent given during registration, which can be withdrawn at any time.
  4. Unsubscribing from the newsletter is possible by clicking the unsubscribe link in each message or by contacting via email.

4. Personal Data

  1. The administrator of personal data is Zmyślni.
  2. The processed data includes: email address (for newsletter subscription), and in case of contact — also name, surname, delivery address, phone number.
  3. Personal data is processed for the purpose of:
    • handling correspondence and orders,
    • sending the newsletter,
    • fulfilling legal obligations (e.g., accounting),
    • analyzing user behavior and personalizing content (profiling).
  4. Data may be transferred to IT service providers, analytical tools, courier companies, and accounting firms.
  5. Data is stored for the period necessary to achieve the purpose or until consent is withdrawn.
  6. The user has the right to:
    • access data, rectify, delete, limit processing,
    • object to processing and profiling,
    • data portability,
    • withdraw consent at any time,
    • lodge a complaint with the President of the Office for Personal Data Protection.
  7. Providing data is voluntary but necessary to use the newsletter or process an order.

5. Cookies and Analytics

  1. The website uses cookies solely to ensure its proper functioning and to anonymously collect basic statistical data.
  2. The collected analytical data does not allow for user identification and is not combined with any other information.
  3. The Administrator does not use cookies for marketing purposes, content personalization, or user profiling.
  4. Technical cookies (necessary for the website to function) are saved automatically. The user can limit or block their operation in the browser settings, which may affect the functionality of the website.

6. Final Provisions

  1. The Terms and Conditions may be changed. The new version will be published on the website with the appropriate effective date.
  2. A user who does not accept the changes should stop using the website or unsubscribe from the newsletter.
  3. In matters not regulated by these Terms and Conditions, the relevant provisions of Polish law shall apply.
  4. In the case of consumers, any disputes will be resolved by the court having jurisdiction in accordance with the provisions of the Code of Civil Procedure.
  5. In the case of users who are not consumers, the court competent to resolve disputes is the court having jurisdiction over the registered office of Zmyślni.
  6. The Administrator is not responsible for interruptions in the availability of the website resulting from technical reasons, force majeure, or circumstances beyond its control (e.g., failures of external systems, hosting providers, internet).
  7. The website may contain links to external services. The Administrator is not responsible for the privacy policies or content of these sites.
  8. All content placed on the website, including descriptions, photos, and graphics, is protected by copyright and is the property of Zmyślni. Copying, distributing, or using them without the owner's consent is prohibited.
